Terms & Conditions

1. Definitions

Throughout this document, the following terms carry specific meaning. "Service" refers to any residential living arrangement, activity, amenity, or support provided by Wihan Terrace. "Resident" or "You" means any individual who books, occupies, or participates in any Wihan Terrace program. "We," "Us," or "Our" refers to Wihan Terrace, operating at 28 Moo 8, Hang Dong-Samoeng Road, Hang Dong, Chiang Mai 50230, Thailand. "Agreement" means these Terms & Conditions together with any signed residency contract. "Community" refers to the Wihan Terrace property, shared spaces, and the collective group of current residents and staff.

2. Acceptance of Terms

By submitting an inquiry, booking a Trial Living Week, or entering into any residency arrangement with Wihan Terrace, you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions. If you are arranging a stay on behalf of a family member, you confirm that you are authorised to agree to these terms on their behalf. All residents and arranging family members must be at least 18 years of age to enter into this agreement.

3. Description of Services

Wihan Terrace provides non-medical senior residential living in Chiang Mai, Thailand. Our offerings include short-term trial stays, month-to-month companion living arrangements, and longer-term private residence placements. All arrangements include accommodation, daily meals, housekeeping, and access to community programming. Specific inclusions vary by arrangement type and are detailed in the relevant service description and individual residency agreement. Wihan Terrace does not provide medical care, nursing services, or clinical treatment of any kind. Residents requiring ongoing medical attention should arrange this independently with local healthcare providers.

4. Eligibility and Residency Requirements

Our community is designed for seniors who are able to manage their day-to-day personal care independently or with minimal non-medical support. Prospective residents or their families may be asked to provide basic health and mobility information before arrival so that we can confirm suitability and prepare appropriate accommodations. Wihan Terrace reserves the right to decline or discontinue a stay if, in our reasonable judgement, a resident's care needs exceed what our non-medical community can safely support.

5. Booking and Payment Terms

A booking is confirmed once we receive the required deposit and a signed residency agreement. Trial Living Week bookings require full payment in advance. Companion Living arrangements require the first month's fee prior to move-in, with subsequent payments due on the first of each calendar month. Premium Private Residence placements follow a twelve-month agreement with payment terms outlined in the individual contract. All prices are quoted in Thai Baht (THB). Payment may be made via bank transfer or other methods specified at the time of booking. Late payments exceeding fifteen days may incur a service charge of 1.5% per month on the outstanding amount.

6. Cancellation and Refund Policy

For Trial Living Week stays, cancellations made more than fourteen days before the scheduled arrival date will receive a full refund. Cancellations between seven and fourteen days before arrival are eligible for a 50% refund. Cancellations fewer than seven days before arrival are non-refundable. For Companion Living, residents may end their arrangement with thirty days' written notice. Any prepaid fees for the unused portion of a full calendar month will not be refunded. Premium Private Residence cancellations are governed by the terms of the individual twelve-month contract, which will detail early termination provisions and any applicable fees.

7. Resident Responsibilities

Residents are expected to treat fellow community members and staff with courtesy and consideration. The following conduct is expected at all times: respect for shared spaces and property, adherence to community quiet hours and communal meal schedules, responsible use of common areas and amenities, and prompt communication with staff regarding any concerns, maintenance needs, or changes in personal wellbeing. Activities that cause disruption, pose safety concerns, or detract from the comfort of other residents may result in a discussion with community management and, if necessary, modification or termination of the residency arrangement.

8. Community Guidelines

Wihan Terrace maintains a welcoming environment for all residents. Smoking is permitted only in designated outdoor areas. Pets are not currently accommodated in any residency arrangement. Overnight guests are welcome for Premium Private Residence holders using the guest accommodation provided, and for other residents with advance coordination through staff. Alcohol consumption in moderation is a personal choice; however, intoxication that affects others or community harmony is not acceptable. All residents receive a detailed community handbook upon arrival outlining day-to-day expectations and practical information.

9. Intellectual Property

All content on the Wihan Terrace website—including text, photographs, graphics, logos, and page layouts—is owned by or licensed to Wihan Terrace and is protected under applicable intellectual property laws. You may view and print content for personal, non-commercial purposes. Reproduction, distribution, or commercial use of any content without prior written consent is not permitted.

10. Liability and Disclaimers

Wihan Terrace provides non-medical residential living services with care and professionalism. However, we do not provide healthcare, clinical diagnosis, rehabilitation, or medical supervision. Residents participate in all activities at their own discretion and should consult their personal physician regarding any health-related concerns. Wihan Terrace shall not be held liable for injuries, illness, loss of personal belongings, or other incidents except where directly caused by proven negligence on our part. Our total liability in any claim shall not exceed the fees paid by the resident for the month in which the incident occurred.

11. Insurance and Personal Belongings

We strongly recommend that all residents maintain personal health insurance that covers their stay in Thailand, as well as travel insurance where applicable. Wihan Terrace is not responsible for the loss, damage, or theft of personal items. Residents are encouraged to carry appropriate insurance for valuable personal belongings and to use any secure storage provided.

12. Termination

Either party may terminate a Companion Living arrangement with thirty days' written notice. Trial Living Week stays conclude at the end of the booked seven-day period. Premium Private Residence termination is subject to the individual twelve-month contract. Wihan Terrace may also terminate a residency with reasonable notice if a resident's behaviour repeatedly breaches community guidelines, if the resident's care needs can no longer be safely met in a non-medical setting, or if payment obligations remain unresolved after reasonable attempts at resolution. In all cases, we aim to handle transitions with respect and to assist wherever possible.

13. Force Majeure

Wihan Terrace shall not be liable for failure to perform its obligations where such failure results from circumstances beyond reasonable control, including but not limited to natural disasters, government actions, pandemics, civil unrest, or significant infrastructure disruptions. In such events, we will make reasonable efforts to communicate with residents and their families and to resume normal operations as soon as practicable.

14. Governing Law and Dispute Resolution

These Terms & Conditions are governed by and construed in accordance with the laws of the Kingdom of Thailand. In the event of any dispute arising from or relating to these terms or your stay at Wihan Terrace, both parties agree to first attempt resolution through informal discussion and, if needed, through mediation conducted in Chiang Mai. If mediation does not produce a satisfactory outcome, disputes shall be submitted to the competent courts of Chiang Mai Province, Thailand.

15. General Provisions

These Terms & Conditions, together with any signed residency contract, constitute the entire agreement between you and Wihan Terrace regarding the matters described here. If any provision of these terms is found to be unenforceable, the remaining provisions shall continue in full effect. A failure by Wihan Terrace to enforce any right under these terms does not constitute a waiver of that right. We may not assign our obligations under these terms without providing notice; residents may not transfer their residency arrangement to another person without written consent.

16. Changes to These Terms

Wihan Terrace may revise these Terms & Conditions from time to time. When changes are made, the "Last Updated" date at the top of this page will reflect the revision. For residents with active arrangements, material changes will be communicated directly via email or in writing at least thirty days before taking effect. Continued use of our website or services after the revised terms are posted signifies your acceptance of the updated conditions.
